The Documents Needed For Sales Or Title Deed
Buying property in Turkey is far less complicated than in the UK. The Estate Agent plays a more active role in "managing" the process. Generally speaking the entire process takes between 6 to 12 weeks.
Foreign nationals may purchase most types of property in Turkey in their own names if and when the time comes to sell, the proceeds of the sale may be transferred out of Turkey.

Cesme Estates portfolio of properties have all been checked to ensure each has a valid title deed (tapu) and are marketed at the current market rate. We have full permissions to market the properties on behalf of their owners.

When you have expressed an interest in buying a property, an agreement is prepared either by Cesme Estates or a solicitor should you choose to use one, setting out the terms and conditions of the purchase. A duly signed copy of that agreement and a copy of the title-deed of the property are given to you.

At this stage, you are only required to give a copy of your passport and two photographs.

Before leaving for Europe, it is advisable to open a bank account. Power of attorney is normally given to either a solicitor (we can recommend an English speaking one and arrange a meeting for you), or ourselves at Cesme Estates.  Power of Attorney means to give another party (normally solicitor or estate agent the power to sign for your property on your behalf, whilst you are out of Turkey).

Once
you make a payment according to the payment schedule clearly defined in the agreement.

Upon this payment, the proceedings at the Title-Deeds Office are initiated by us.

The owner of the property/seller will prepare an application form , a copy of the property legal papers, together with the copy of your passport and send them to the Army Headquarters in İzmir for clearance.This process will take between 6 to 12 weeks approx, and we will watch the procedure on behalf of the client/purchaser. From the 1st January 2006, the property location has to be checked by the municipality. A 1/25000 and 1/1000 cadastrol map is required for this purpose. The check is carried out to ensure that the land you are buying does not fall within any military zone. Depending on the area of purchasing dictates the Military application fee, to be paid by the purchaser. Character checks are also made.

When all the checks have been conducted and the papers returned to us, we will contact you so that you can arrange a suitable date to return to Turkey to collect your title deed/tapu and undertake the final money transfer.

On the day of transfer, the Buyer, Vendor and Estate Agent will go to the Title Deeds Office and complete the paperwork. The paperwork consists of all the legal issues (title deeds, land registry etc) and financial issues. Financial affairs are concluded, signatures exchanged and the title deeds of your property are registered in your name .

After you have purchased the property we will accompany you to the various department offices to get the utilities changed to your name, ( Water+ Electric ).

Foreign Ownership

Foreigners are allowed to own freehold property in  Turkey away from military zones if the country they herald from has a reciprocal agreement; i.e., if your country of residence allows Turkish residents to own property in your country then you can buy in Turkey!
